Portugal IFICI Explained: Who Qualifies for the New NHR 2.0 Tax Regime

What Is IFICI and How Did It Replace the Old NHR?
Portugal closed its original Non-Habitual Resident (NHR) programme in December 2023. In its place, the government introduced the Fiscal Incentive for Scientific Research and Innovation - known as IFICI, or NHR 2.0.
The new regime targets a narrower group than its predecessor. Where the old NHR was broadly accessible, IFICI focuses on researchers, highly qualified professionals, and workers in specific sectors. The core benefit is a 10-year window (non-renewable) of preferential tax treatment.
The Main Tax Benefits
For qualifying professionals, IFICI offers a 20% flat rate on eligible Portuguese-sourced employment and self-employment income. The standard alternative is Portugal's progressive scale, which runs from 14.5% up to 53%.
Foreign-sourced income from employment, business profits, interest, dividends, rental income, and royalties can be fully exempt - provided the source country has a Double Taxation Agreement (DTA) with Portugal or is not on a blacklisted jurisdiction list. Portugal maintains DTAs with approximately 80 countries.
Two important caveats from the source:
- Pension income is excluded. Unlike the old NHR, which offered a flat 10% rate on foreign pensions, IFICI provides no pension benefit. Foreign pensions fall under the standard progressive rates of 14.5% to 53%.
- Capital gains treatment is unresolved. The tax status of capital gains under IFICI was still awaiting final regulations at the time of writing.
Who Can Apply?
To be eligible, you must:
- Have become a Portuguese tax resident after January 1, 2024
- Not have been a Portuguese tax resident during the preceding 5 years
- Not have previously used the old NHR regime or the "ex-residents" programme
On qualifications, the rules require either European Qualifications Framework (EQF) level 6 - roughly a bachelor's degree - combined with proven professional experience, or EQF level 8 (a PhD), which removes the experience requirement.
Qualifying professions listed in the source include university professors, medical doctors, specialists in mathematics, physics, and engineering, ICT specialists, company directors, and managers of administrative and commercial services.
Which Employers and Sectors Qualify?
Your employer also has to meet criteria. A company must export at least 50% of its turnover and operate within certain Portuguese activity codes. Qualifying sectors include:
- Transformative industries (divisions 10-33)
- Information and communication, including software, data hosting, and publishing (divisions 58-63)
- Research and development in physical and natural sciences (group 721)
- Higher education (subclass 85420)
- Human health activities (subclasses 86100 to 86904)
Alternative routes exist for R&D staff eligible under Portugal's SIFIDE programme, directors or employees of accredited Portuguese startups, and researchers with PhDs working inside Portugal's scientific network.
How to Apply and Key Deadlines
Applications must be submitted by January 15 of the year following the year you established tax residency in Portugal. Missing this window closes the door for that year.
The reviewing authority depends on your route. Startup employees go through Startup Portugal. Professionals at export-focused companies apply via the Tax Authority. Those attached to entities doing work relevant to the national economy apply through AICEP or IAPMEI.
Supporting documents typically include proof of academic qualifications, your employment contract, a current company registration certificate, and an employer statement confirming the company's activity qualifications. The Tax Authority is expected to confirm IFICI status by March 31 each year.
